By accessing or using the FashionOS mobile application, website at fashionosapp.com, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Description of Services

FashionOS is a fashion discovery platform that helps users discover, save, and organize clothing and fashion products. Our Services include personalized product recommendations, a digital closet for organizing saved items, outfit creation tools, and curated fashion content from various retailers.

3. Eligibility

You must be at least 13 years old to use our Services. By using our Services, you represent that you are at least 13 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. User Accounts

Some features of our Services require you to create an account. When you create an account, you agree to:

• Maintain the security of your account credentials
• Promptly update your account information if it changes

FashionOS displays product information from third-party retailers. We do not sell products directly. Product availability, pricing, and descriptions are provided by third-party retailers and may change without notice. We make reasonable efforts to display accurate information but do not guarantee the accuracy, completeness, or reliability of any third-party content. Purchases are made directly with the respective retailer and are subject to their terms and policies.

7. Intellectual Property

The FashionOS name, logo, app design, and original content are the property of FashionOS LLC and are protected by copyright, trademark, and other intellectual property laws. Product images and descriptions displayed within the app are the property of their respective brands and retailers. You may not copy, modify, distribute, or create derivative works based on our proprietary content without our written permission.

8. User Content

You retain ownership of any content you create within FashionOS, such as outfit boards and collections. By creating content on our platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and store that content as necessary to provide our Services. You may delete your content at any time.

9. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our Services will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, FashionOS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our Services.

11. Indemnification

You agree to indemnify and hold harmless FashionOS LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of our Services or violation of these Terms.

12. Modifications to Services and Terms

We reserve the right to modify, suspend, or discontinue any part of our Services at any time. We may also update these Terms from time to time. We will notify you of material changes by posting the updated Terms and revising the "Last updated" date. Your continued use of our Services after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.

14. Apple App Store Terms

If you access FashionOS through the Apple App Store, the following additional terms apply:

• These Terms are between you and FashionOS LLC only, not with Apple Inc. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support services for the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims relating to the app, including product liability, regulatory compliance, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
